The Board of Directors authorized the wind down of Hostess Brands to preserve and maximize the value of the estate after one of the Company’s largest unions, the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union (BCTGM), initiated a nationwide strike that crippled the Company’s ability to produce and deliver products at multiple facilities.
I wonder if the shareholders of Hostess Brands could sue the BCTGM Union for damages, since the union is directly responsible for the "nationwide strike that crippled the Company’s ability to produce and deliver products at multiple facilities".

Shareholders have successfully sued for lesser reasons.
lol unions, serves them right ... its not like they are fucking scientist or doctors
Average employee is just plain fucked, regardless.

I'm thinking it'd be a win-win if the executive shareholders and union decided to bleed each other out in a protracted legal fight.

I see the 'win' for anyone who isn't an executive or union member, but who is the second 'win' for? It's a lose-lose for parties directly concerned, surely. Unless you mean to suggest that they actually wish to commit financial suicide?

I prefer Little Debbie anyway, better pricing.

PS, I love the irony of this story.

Win #1, as the union gets bled dry from legal costs.
Win #2, as the executive shareholders get bled dry from legal costs.

It's like a cagematch fight to the death between Oprah Winfrey and Rosie O'Donnell, with the winner getting the last Twinkie on Earth;
You're not cheering for either one to actually win, you just want to see them both tear each other apart.
