When is murder legal?

If a soldier goes on holiday and kills someone that's murder right? At what point is it legal for a soldier to kill another country's citizens? Do you have to legally declare war?

By the way I'm not implying anything. Could be any country, nationality or army.

Your question makes no sense. A soldier cannot legally delcare war - only his government can. That right is self granted by the documents that established the government. Modern armies require their forces to carry arms even when "off duty" in a combat zone. So if a soldier is in a combat zone, and fires on orders or in self-defense, then it's not murder definition, unless you are on the wrong side of the gun.

So, what is the question you are really trying to ask?

Am I right in that other thread when I say that an overwhelmingly large number of Australians are American-haters? I just think it's odd that nobody realizes that identifying hatred against an entire nation is just so completely rash (and by association, ignorant).

Murder is legal in self defense. But you have to prove that you reasonably believed that your life was so far in danger that you had to use lethal force in order to protect yourself.

There are two types of self defense: Perfect self defense and imperfect self defense. In perfect self defense you are neither the agressor nor do you use deadly force. Imperfect self defense includes both of those factors. It is much harder to prove perfect self defense when you use deadly force but it is not an uncommon defense in murder cases.

Say that you are beaten daily by an abusive husband. One day you decide to fight back and in turn kill him. Is that not pre meditated?
